1. Basic concepts of the terms and conditions

1.2 The buyer or customer

The person who uses the Webshop service, i.e. the www.bonolact.hu registers on the internet interface and orders and purchases goods and services through this interface.

1.3 Supplier data

1.3.1 Our delivery partner delivers our goods in accordance with the contract concluded with it, based on its own general terms and conditions, at the fees that can be viewed under the “delivery/payment” menu item.

2. Purpose of the Web Store Terms and Conditions

MTKI Kft. has issued the Web Store Terms and Conditions in order to regulate in detail the terms and conditions related to the Web Store service and its use, the rights and obligations of the service provider and the customer and other important circumstances related to the Web Store service.

The Web Store Terms and Conditions contain the general terms and conditions of the legal relationship between MTKI Kft. and the customer entering into a contractual relationship with it. Regarding issues not regulated here, the Hungarian laws and official regulations in force at all times regarding the activities of the service provider Web Store, as well as the provisions of the Civil Code, shall apply without any separate stipulation.

2.1 Publication of the Web Store Terms and Conditions

The acceptance of the Web Store Terms and Conditions by the customer is a prerequisite for using the Web Store service. The conditionsIt is considered acceptance of the site if the customer uses the service, i.e. registers.

2.2 Scope of the Web Store Terms and Conditions

MTKI Kft. reserves the right to modify the Web Store Terms and Conditions in whole or in part at any time. The Web Store Terms and Conditions and any amendments thereto shall enter into force upon publication. The Web Store Terms and Conditions shall remain in force as long as the Web Store Service Provider provides the Web Store service, and for matters that began before termination but have not yet been closed, until their closure.

3. The Web Store Service

MTKI Kft. provides the Web Store service to the customer according to the following conditions.

3.1 Territorial scope of the Web Store service

The data network management interface maintained by the Web Store service provider is accessible both domestically and abroad due to the characteristics of the data network (internet). However, MTKI Kft. only accepts orders addressed to the territory of the Republic of Hungary. Delivery to postal or other addresses outside the territory of the Republic of Hungary is therefore not possible.

3.4 MTKI Kft. makes the following statement regarding the storage of the above-mentioned data

By accepting these GTC, the customer agrees to the storage, archiving, and has entrusted MTKI Kft. with the management of the data, which has undertaken to keep the data confidential, will not disclose it to third parties based on the existing legal relationship, and will store it securely on its servers.

4. Formation and modification of the Web Store contract

4.1 General characteristics

The contract is concluded by registering on the service provider’s Internet interface and accepting these terms and conditions. Registration is a condition for purchasing in the Web Store. Orders are concluded when the customer approves the order in its final form. MTKI Kft. reserves the right to delete the data upon receipt of orders, if the authenticity of the registration data is questionable or unintelligible, and to classify the orders placed with these data as invalid.

4.2 Registration

During the Webshop registration, after providing the customer’s data, the customer has the ability to place the order. The customer can freely select from the product range without logging in and add them to their cart. The customer can log in to the store with their username and password, and then purchase the products collected in their cart without logging in. The purchase is made by using the button on the website for this purpose.

4.3 Modifying and canceling an order

Pursuant to Act CVIII of 2001, when placing an order, the webshop software immediately sends a notification to the customer about the fact that the order has been accepted. If the customer does not receive this within 48 hours, the customer’s obligation to make an offer will cease. MTKI Kft. gives the customer the opportunity to cancel their order electronically until the order has been fulfilled. When the order has been fulfilled, the customer will receive an e-mail notification of the fact that the fulfillment has begun, after which it is only possible to cancel their order in person (at the customer service contact details), which the customer service of MTKI Kft. can accept or reject based on the following guidelines:

In the case of cash payment by courier service, it can be accepted for orders that have not been handed over to the courier service. If the courier service has taken over the products to be delivered from MTKI Kft., you may exercise this right upon delivery.

In the case of payment by bank card, the cancellation of the order may be accepted according to the rules of cash payment, with the proviso that the transferred money will be returned to the customer within 30 days, and in this case, the costs incurred during bank transactions will be passed on to the customer, deducting these costs from the returned money.

4.4 Payment terms

The customer shall pay the consideration for the purchased goods and services electronically (by bank card) when placing the order, or when receiving the goods from the courier in cash, or by direct transfer to the bank account of MTKI Kft. MTKI Kft. issues an invoice for the receipt of the cash. The buyer may receive all items of the order at once or may refuse to receive the entire order. If the customer refuses to accept the order, MTKI Kft. reserves the right to terminate the customer’s registration and to invalidate any orders placed in the meantime, based on individual discretion.

MTKI Kft. does not charge a fee for using a given payment method that exceeds the costs incurred by it in connection with the payment method.

I acknowledge that the following personal data of mine stored in the user database of www.bonolact.hu by the data controller of the Hungarian Dairy Experimental Institute Limited Liability Company (9200 Mosonmagyaróvár, Csiszár József u. 1.) will be transferred to SimplePay Zrt., as the data processor. The scope of data transmitted by the data controller: name, e-mail address, delivery address, telephone number. 4.5 In case of unsuccessful delivery

With a general delivery deadline, the supplier will attempt to deliver the ordered goods twice. After that, the Customer may receive the products at the designated postal delivery location for a further 5 days. If you do not do this, the seller will declare the order invalid and cancel it after the goods have been returned.

4.6 Order tracking service

The customer service will provide information on your questions regarding the order.

5. Buyer’s rights and obligations

5.1 Right of withdrawal

The buyer has the right to withdraw the ordered product from the service provider within 14 days of receipt and to return it to the service provider in its entirety within 14 days of withdrawal. In accordance with Government Decree 45/2014. (II. 26.), the costs of return are borne by the buyer. In order to avoid disputes, a video recording of the opening of the package containing the returned goods will be made. The Seller is obliged to return the amount of the consideration for the goods, after deducting the verifiable costs incurred, to the Buyer within 30 days of receipt of the package. The right of withdrawal also exists between the conclusion of the contract and the receipt of the product.

If it is not possible to withdraw from the contract for a product – due to its nature – this will be indicated separately in the product description.

A recommended sample of the withdrawal declaration is attached. Using text other than the recommended sample does not mean that the withdrawal is invalid: the service provider considers the withdrawal to be valid if the intention to withdraw is clearly and unambiguously evident from the buyer’s statement, and withdrawal is possible for the product due to its nature.

5.2 Possible damage to MTKI Kft.

If the returned goods are presumed to be damaged and this damage was caused by improper use, MTKI Kft. may demand compensation for the decrease in value caused to the product from the customer in accordance with the above regulation. The parties mutually accept the video recording made by the Seller when the goods were opened as proof of damage to the package.
 
5.3 Warranty

The seller’s warranty and guarantee liability is governed by the Civil Code and Act 151/2003. (IX.22.) are the governing provisions.

6. Data protection, data security

   6.1 Data protection statement

   During the registration required to use the service, MTKI Kft. records the following data about the customers: Data necessary for identifying the customer: the customer’s username, password (one-way encrypted) and electronic mail address. Name, address, contact telephone number. In order to deliver the ordered goods, MTKI Kft. makes the following data available to the supplier or the supplier’s agent: time of order, recipient name (from delivery address), company name (from delivery address), full delivery address, total order amountname, order number, customer’s phone number and other contact details.

   6.2 Modification of personal data

   The customer can modify or delete the personal data provided at any time on the user interface of the Web Store. The deletion of the following data is an exception to this:

   Password
   Name modification
   Unique identifier
   The customer can request the cancellation of the registration via the e-mail address info@webaruhazkft.hu or the customer service phone number. The phone number is not subject to premium rates.

   7. Final provisions

   7.1. Clauses related to contracts between remote parties

   No written contract is concluded on these terms and conditions, and MTKI Kft. does not register them. An exception to this may be our customers with whom we conduct most of our purchase transactions not electronically.

   7.2. Termination of the legal relationship

   The terms and conditions of the Web Store remain in force as long as the Web Store service provider provides the Web Store service, and for matters that began before the termination but have not yet been closed, until they are closed. The buyer may request the immediate termination of the contract at any time, provided that no transaction is in progress and there are no claims from either party. We will acknowledge this after verifying your identity, and we will terminate the user’s ability to use the store by deleting their registration.

   MTKI Kft. reserves the right to unilaterally terminate the contract in the event of inappropriate behavior by the customer, in justified cases.

   7.4. MTKI Ltd.’s liability does not extend to misuse caused by the user’s negligence (e.g., giving out a password to a third party), and it does not assume any financial or moral liability for such misuse. WARRANTY, COMPLAINTS We guarantee the quality of our products to the extent required by law. If the product is proven to be defective, MTKI Ltd. will of course provide a refund or exchange guarantee, which includes the refund of shipping costs or the free sending of a new product. The Customer is entitled to submit his/her complaint and comments in writing to the Seller. The Seller is obliged to examine the complaint within 3 days and notify the Customer in writing of the result and further actions. In the event of a dispute, the consumer may contact a conciliation body.
